Terms of Service

Agreement to these terms

By creating an account, subscribing to, or otherwise using Prop Hound (the “Service”), you agree to be bound by these Terms of Service and our Privacy Policy. If you don’t agree, don’t use the Service.

Eligibility

You must be at least 18 years old and able to form a legally binding contract to use the Service. By using it, you represent that you meet these requirements.

What Prop Hound is

Prop Hound screens rental property listings against criteria you set and surfaces the ones worth a second look, with a plain-English explanation of why. We are not a licensed real estate broker, financial advisor, or investment advisor.

Not financial or investment advice

The information, numbers, and explanations Prop Hound provides are for your own research and convenience. They are not a recommendation to buy any specific property, and they don’t replace your own due diligence, inspections, or professional advice (legal, financial, or otherwise) before making a purchase. You are solely responsible for your investment decisions.

The First Deal Guarantee

If you’re on a plan that includes our guarantee: we’ll find you a deal that clears your own criteria within 30 days of your subscription starting. If we don’t, we’ll refund every dollar you’ve paid us for that subscription. No store credit. To claim it, email hello@prophound.co within 14 days after the 30-day window ends.

This guarantee covers finding you a deal that clears the bar you set with us. It doesn’t cover actually closing on a property. Whether you offer on, get approved for financing on, or close on any deal we surface is between you, your lender, and your agent, and is outside our control. If you never finish setting up your own criteria, we can’t run a nightly screen against nothing. The guarantee applies once your criteria are actually in place, not from the moment you sign up.

Accounts

You’re responsible for keeping your account credentials secure and for the accuracy of the criteria you provide. You’re responsible for all activity that happens under your account. We may suspend or terminate accounts used for abusive, fraudulent, or unlawful activity, or that violate these terms.

Acceptable use

You agree not to:

• Scrape, crawl, or use automated means to access the Service beyond normal individual use;
• Reverse engineer, decompile, or attempt to extract the source code of the Service;
• Resell, sublicense, or provide the Service to third parties as your own;
• Attempt to bypass rate limits, access controls, or account restrictions;
• Use the Service to violate any law, or to harass, defraud, or harm anyone;
• Interfere with or disrupt the Service’s infrastructure or security.

Intellectual property

Prop Hound and its content, features, design, and underlying software are owned by us and protected by intellectual property law. Subscribing gives you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own property research. It doesn’t transfer any ownership rights to you. If you send us feedback or suggestions, we may use them without any obligation to compensate you.

Data accuracy

Property data comes from third-party sources. We work to keep it accurate and current, but we can’t guarantee every listing detail, price, or rent estimate is error-free. Always verify details directly before making an offer.

Billing and cancellation

Paid plans are billed in advance on a recurring basis (monthly or annually, per the plan you choose) and renew automatically until canceled. You can cancel anytime from your billing settings; cancellation takes effect at the end of your current billing period, and access continues until then. Except where our guarantee applies, fees already paid are non-refundable. We may change our pricing going forward; we’ll give active subscribers notice before a price change takes effect.

Disclaimer of warranties

The Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We don’t warrant that the Service will be uninterrupted, error-free, or free of harmful components, or that any property listing, match, or analysis will be accurate or complete.

Limitation of liability

To the maximum extent permitted by law, Prop Hound and its owners, employees, and contractors won’t be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from your use of the Service, even if we’ve been advised of the possibility of such damages. Our total liability for any claim arising from these terms or the Service is limited to the amount you paid us in the 12 months before the claim arose, except where our guarantee explicitly provides otherwise.

Indemnification

You agree to indemnify and hold Prop Hound harmless from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your use of the Service, your violation of these terms, or your violation of any third party’s rights.

Termination

You may stop using the Service and cancel your account at any time. We may suspend or terminate your access for violating these terms, non-payment, or any reason with reasonable notice. Sections of these terms that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnification) will survive.

Dispute resolution and arbitration

You and Prop Hound agree to resolve any dispute arising from these terms or the Service through binding individual arbitration rather than in court, except that either party may bring an individual claim in small claims court. This means you and Prop Hound each waive the right to a jury trial and to participate in a class action or class-wide arbitration. You may opt out of this arbitration agreement by emailing hello@prophound.co within 30 days of first accepting these terms and stating you opt out of arbitration. If you’re a consumer in Quebec, this section doesn’t apply to you, and you keep your right to go to court and to take part in a class action.

Governing law

These terms are governed by the laws of the Province of Quebec and the federal laws of Canada that apply there, without regard to conflict-of-law principles, except where the arbitration agreement above applies. Nothing in these terms takes away any rights you have under the consumer protection laws where you live.

General

If any part of these terms is found unenforceable, the rest remains in effect. These terms, together with our Privacy Policy, are the entire agreement between you and Prop Hound regarding the Service. Our failure to enforce any part of these terms isn’t a waiver of it. You may not assign these terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.

Changes

We may update these terms as the product evolves. We’ll do our best to flag material changes to active users.
